The general rule is that in both the private and public sectors, the employees retain the right to conduct their private lives as they see fit without the interference of their employer, and the employer has just cause to discipline employees only if there is a nexus (connection) between the off-duty conduct and the employment. However, there is more focus on public employees when it comes to off-duty conduct, they are subject to closer scrutiny and discipline is more likely than in the private sector because these are public servants. The term nexus is used to refer to establishing the connection between an employee’s off-duty misconduct and their employment. There must be prove to show that an employee’s actions affect their work or how they will carry out their work responsibilities.
